Odpov\u00edd\u00e1 na evalua\u010dn\u00ed ot\u00e1zky reflektuj\u00edc\u00ed jak m\u00edru souladu v\u00fdstup\u016f tohoto n\u00e1stroje s ofici\u00e1ln\u00edm metodick\u00fdm r\u00e1mcem, tak jejich re\u00e1lnou podobu, obsah a specifika. V\u00fdzkumn\u00fd vzorek \u010d\u00edtaj\u00edc\u00ed 236 v\u00fdstup\u016f z hodnocen\u00ed realizovan\u00fdch t\u0159emi ministerstvy za \u010dasov\u00e9 obdob\u00ed 2007\u20132014 je podroben evaluaci pomoc\u00ed vlastn\u00edho analytick\u00e9ho n\u00e1stroje. V\u00fdstupy anal\u00fdzy jsou n\u00e1sledn\u011b triangulov\u00e1ny prost\u0159ednictv\u00edm proveden\u00fdch expertn\u00edch rozhovor\u016f. Zji\u0161t\u011bno je, \u017ee hodnocen\u00ed dopad\u016f na rovnost je poznamen\u00e1no \u010dast\u00fdm nesouladem s&nbsp;metodick\u00fdm r\u00e1mcem, upoza\u010fov\u00e1n\u00edm a&nbsp;bagatelizac\u00ed dopad\u016f na rovnost, n\u00edzkou variabilitou a mechanickou tvorbou hodnot\u00edc\u00edch formulac\u00ed, simult\u00e1nn\u00edm hodnocen\u00ed v\u00edce r\u016fzn\u00fdch dopad\u016f a pouze povrchn\u00ed znalost\u00ed genderov\u00e9 oblasti ze strany ministerstev. Nav\u00edc jsou zde i p\u0159ek\u00e1\u017eky syst\u00e9mov\u00e9, kter\u00fdmi jsou indiferentn\u00ed p\u0159\u00edstup k&nbsp;genderov\u00e9 problematice, absence jednotn\u00e9 metodiky hodnocen\u00ed dopad\u016f na rovnost, protich\u016fdnost a neadekv\u00e1tnost novel metodick\u00e9ho r\u00e1mce a&nbsp;limitovanost person\u00e1ln\u00edch kapacit kl\u00ed\u010dov\u00fdch akt\u00e9r\u016f. Identifikov\u00e1ny jsou v\u0161ak i prom\u011bny, a to zejm\u00e9na v rozsahu hodnot\u00edc\u00edch formulac\u00ed a v syst\u00e9mov\u00fdch \u010dinnostech na podporu genderov\u00e9 problematiky. \u010cl\u00e1nek zp\u0159es\u0148uje d\u0159\u00edv\u011bj\u0161\u00ed v\u00fdzkumy t\u00fdkaj\u00edc\u00ed se RIA v \u010cesk\u00e9 republice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Abstract<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regulatory Impact Assessment (RIA) in the Czech Republic and namely its part focusing on equality between men and women is considerably underresearched in terms of its real form, content and specifics of the RIA performance as well as the extent of its compliance with the official guidelines. The dataset containing 236 outputs of the RIA performed by three ministries in 2007\u20132014 is put to evaluation through the created analytical tool. Subsequently, the outcomes of the analysis are triangulated through expert interviews. The paper concludes that the RIA on equality between men and women is affected by the low compliance with the guidelines, overshadowing and downplaying of the impact on equality, low variability and mechanical creation of the assessment outputs, simultaneous assessment of more and different impacts and solely superficial knowledge of the gender issue. In addition, systemic obstacles, including indifferent approach to the gender issue, absence of unified methodology for RIA on&nbsp;equality between men and women, contradiction and inadequacy ofthe guidelines novelizations and limited personnel capacity of the key actors are identified. However, the transformation is detected, particularly of&nbsp;the&nbsp;assessment output extent and systemic activities aimed to support gender issue. V\u00fdzkumn\u011b je v\u0161ak st\u00e1le podcen\u011bna evaluace tohoto procesu, resp. jeho v\u00fdstup\u016f \u2013 v\u00fdjimku tvo\u0159\u00ed srovn\u00e1vac\u00ed studie Staro\u0148ov\u00e9 (2007, 2010). Tento \u010dl\u00e1nek proto chce vyplnit onu v\u00fdzkumnou mezeru, a to prost\u0159ednictv\u00edm reflexe problematiky hodnocen\u00ed dopad\u016f regulace z&nbsp;perspektivy specifi\u010dt\u011bj\u0161\u00edho hodnocen\u00ed dopad\u016f regulace na rovnost mu\u017e\u016f a \u017een. Volba t\u00e9to specifick\u00e9 perspektivy je d\u00e1na jednak t\u00edm, \u017ee genderov\u00e1 problematika je jednou z&nbsp;oblast\u00ed z\u00e1jmu autorek, jednak t\u00edm, \u017ee jako \u201ehorizont\u00e1ln\u00ed t\u00e9ma\u201c umo\u017e\u0148uje nejenom srovn\u00e1n\u00ed v&nbsp;\u010dase, ale i&nbsp;mezi jednotliv\u00fdmi p\u0159edkladateli legislativn\u00edch dokument\u016f. P\u0159idanou hodnotou takto zac\u00edlen\u00e9ho v\u00fdzkumu je i zmapov\u00e1n\u00ed \u010desk\u00e9 praxe hodnocen\u00ed v&nbsp;\u010dasov\u00e9m obdob\u00ed p\u0159ed implementac\u00ed&nbsp;<em>Metodiky hodnocen\u00ed dopad\u016f na rovnost \u017een a mu\u017e\u016f pro materi\u00e1ly p\u0159edkl\u00e1dan\u00e9 vl\u00e1d\u011b \u010cR<\/em>&nbsp;(Metodika).<a href=\"https:\/\/www.evaltep.cz\/inpage\/dopady-regulace-na-rovnost\/#_ftn1\"><sup>[1]<\/sup><\/a>&nbsp;Dodejme, \u017ee hodnocen\u00ed dopad\u016f regulace z&nbsp;hlediska rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed je slepou skvrnou p\u0159ekvapiv\u011b i pro akademiky zkoumaj\u00edc\u00ed genderov\u00e9 rozm\u011bry politik (srov. Ha\u0161kov\u00e1, K\u0159\u00ed\u017ekov\u00e1 et&nbsp;al. 2003; Ha\u0161kov\u00e1 2005; Kampichler, Machovcov\u00e1 2008; K\u0159\u00ed\u017ekov\u00e1&nbsp;et&nbsp;al. 2005; Kub\u00e1lkov\u00e1, Wennerholm \u010c\u00e1slavsk\u00e1 et al. 2010; Linkov\u00e1 2006; Pavl\u00edk et al. 2004, 2006, 2008; Pavl\u00edk 2005).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">S&nbsp;c\u00edlem vytvo\u0159it z\u00e1kladn\u00ed informa\u010dn\u00ed r\u00e1mec o \u010desk\u00e9 praxi hodnocen\u00ed byly shrom\u00e1\u017ed\u011bny a n\u00e1sledn\u011b analyzov\u00e1ny jednotliv\u00e9 v\u00fdstupy hodnocen\u00ed dopad\u016f regulace na rovnost mu\u017e\u016f a \u017een\/z\u00e1kaz diskriminace, a to u t\u0159ech vybran\u00fdch ministerstev v&nbsp;\u010dasov\u00e9m obdob\u00ed 2007\u20132014. Na\u0161\u00ed ambic\u00ed byla kvantitativn\u011b orientovan\u00e1 obsahov\u00e1 anal\u00fdza v\u00fdstup\u016f \u2013 konkr\u00e9tn\u011b jsme se zam\u011b\u0159ovaly na to, jak v\u00fdstupy z&nbsp;hodnocen\u00ed dopad\u016f napl\u0148ovaly po\u017eadavky definovan\u00e9 v&nbsp;metodick\u00fdch n\u00e1stroj\u00edch pro tvorbu hodnocen\u00ed (Obecn\u00e9 z\u00e1sady pro hodnocen\u00ed dopad\u016f regulace, Legislativn\u00ed pravidla vl\u00e1dy) a&nbsp;jak\u00e9 charakteristiky lze u t\u011bchto v\u00fdstup\u016f identifikovat. Pro tento sm\u011br jsme se rozhodly zejm\u00e9na proto, \u017ee t\u00e9ma dosud nen\u00ed zpracov\u00e1no a \u017ee jsme p\u0159esv\u011bd\u010deny, \u017ee i anal\u00fdza, kter\u00e1 ponech\u00e1 stranou obsahovou kvalitu zpracov\u00e1n\u00ed jednotliv\u00fdch dokument\u016f a soust\u0159ed\u00ed se \u201ejen\u201c na form\u00e1ln\u00ed pln\u011bn\u00ed po\u017eadavk\u016f dan\u00fdch metodickou oporou, p\u0159edstavuje d\u016fle\u017eit\u00fd p\u0159\u00edsp\u011bvek k&nbsp;diskuzi o \u010desk\u00e9m hodnocen\u00ed dopad\u016f regulace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u010cl\u00e1nek postupuje od p\u0159edstaven\u00ed hodnocen\u00ed dopad\u016f regulace jako n\u00e1stroje a \u010desk\u00e9ho metodick\u00e9ho r\u00e1mce pro hodnocen\u00ed dopad\u016f na rovnost mu\u017e\u016f a \u017een, n\u00e1sledn\u011b vysv\u011btluje metody sb\u011bru a anal\u00fdzy dat, tj. povahu evalua\u010dn\u00edho p\u0159\u00edstupu a analytick\u00e9ho n\u00e1stroje a kone\u010dn\u011b p\u0159edstavuje i kl\u00ed\u010dov\u00e9 v\u00fdstupy z evaluace.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Hodnocen\u00ed dopad\u016f regulace na rovnost mu\u017e\u016f a \u017een v&nbsp;\u010desk\u00e9m kontextu<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Hodnocen\u00edm dopad\u016f regulace (RIA) je, v \u0161ir\u0161\u00edm pojet\u00ed, m\u00edn\u011bn komplexn\u00ed proces p\u0159\u00edpravy regulac\u00ed \u2013 od definov\u00e1n\u00ed c\u00edl\u016f, anal\u00fdzy kontextu, identifikace variant \u0159e\u0161en\u00ed, jejich vyhodnocen\u00ed a\u017e po n\u00e1sledn\u00e9 hodnocen\u00ed vliv\u016f identifikovan\u00fdch variant (Staro\u0148ov\u00e1 2009, s. 14). V&nbsp;pojet\u00ed u\u017e\u0161\u00edm jde o soubor metod maj\u00edc\u00ed za \u00fakol systematicky, d\u016fsledn\u011b a kriticky hodnotit navrhovan\u00e9 \u010di existuj\u00edc\u00ed regulace, a to zejm\u00e9na formou identifikace potencion\u00e1ln\u00edch pozitivn\u00edch a negativn\u00edch dopad\u016f (OECD&nbsp;2009; Paterov\u00e1 2008, s.&nbsp;28\u201330). Normativn\u011b vzato maj\u00ed v\u00fdstupy RIA vysokou v\u00fdpov\u011bdn\u00ed a informa\u010dn\u00ed hodnotu, je\u017e je st\u011b\u017eejn\u00ed pro tvorbu optim\u00e1ln\u00edho, informovan\u00e9ho a kvalitn\u00edho politick\u00e9ho rozhodnut\u00ed (Staro\u0148ov\u00e1 2009, s. 14). RIA je z&nbsp;tohoto d\u016fvodu pova\u017eov\u00e1no za kl\u00ed\u010dov\u00fd n\u00e1stroj regulatorn\u00ed reformy a snahy o&nbsp;zkvalit\u0148ov\u00e1n\u00ed rozhodovac\u00edho a regulatorn\u00edho procesu (Francov\u00e1 2006, s.&nbsp;3\u20134; Staro\u0148ov\u00e1 2009, s. 20\u201321). Z\u00e1vaznost jmenovan\u00fdch aktivit pro \u010ceskou republiku (\u010cR) vypl\u00fdv\u00e1 jak z&nbsp;participace na strategick\u00fdch aktivit\u00e1ch mezin\u00e1rodn\u00edch organizac\u00ed (Organizace pro hospod\u00e1\u0159skou spolupr\u00e1ci a&nbsp;rozvoj, Evropsk\u00e1 Unie), tak c\u00edl\u016f vlastn\u00edch legislativ (Strategie zlep\u0161ov\u00e1n\u00ed\u20262006, s.&nbsp;3; Vl\u00e1da&nbsp;\u010cR 2004). RIA lze aplikovat na \u0161irok\u00e9 spektrum oblast\u00ed \u2013 typicky hospod\u00e1\u0159sk\u00e1, soci\u00e1ln\u00ed, environment\u00e1ln\u00ed \u2013 mezi kter\u00e9 pat\u0159\u00ed i&nbsp;rovnost mu\u017e\u016f a \u017een (Pomaha\u010d, Vidl\u00e1kov\u00e1 2002).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z&nbsp;anal\u00fdzy hodnot\u00edc\u00ed praxe, kterou provedla v&nbsp;\u010cR a \u010dty\u0159ech dal\u0161\u00edch \u010dlensk\u00fdch st\u00e1tech p\u0159istoupiv\u0161\u00edch do Evropsk\u00e9 Unie v&nbsp;roce 2004 Staro\u0148ov\u00e1 (2010), vypl\u00fdv\u00e1 \u0159ada charakteristik RIA v\u00edce \u010di m\u00e9n\u011b typick\u00fdch pro danou zemi. V&nbsp;p\u0159\u00edpad\u011b \u010cR jde o&nbsp;ned\u016fsledn\u00e9 dodr\u017eov\u00e1n\u00ed povinnosti za\u0159azovat RIA k&nbsp;nov\u011b p\u0159edkl\u00e1dan\u00e9 legislativ\u011b, formalizmus a mechani\u010dnost, resp. v\u00e1gnost p\u0159i formulov\u00e1n\u00ed stanoviska. Zji\u0161t\u011bna v\u0161ak je i vysok\u00e1 kvalita hodnocen\u00ed (pokud u\u017e k&nbsp;n\u011bmu tedy do\u0161lo \u2013 v&nbsp;anal\u00fdze roku 2010 se ocitlo pouze 12 p\u0159\u00edpad\u016f), by\u0165 omezen\u00e1 sp\u00ed\u0161e na finan\u010dn\u00ed a rozpo\u010dtov\u00e9 dopady. Vysokou kvalitu hodnocen\u00ed vysv\u011btluje Staro\u0148ov\u00e1 t\u00edm, \u017ee v&nbsp;jej\u00edm v\u00fdzkumn\u00e9m vzorku dominovaly RIA proveden\u00e9 ministerstvem vnitra, kter\u00e9 bylo koordin\u00e1torem implementace RIA, a ministerstvem informatiky, kter\u00e9 RIA pilotovalo. Ob\u011b instituce tedy m\u011bly s&nbsp;hodnocen\u00edm zku\u0161enosti, kter\u00e9 se z\u00faro\u010dily v&nbsp;kvalitn\u011b odveden\u00e9 pr\u00e1ci; z\u00e1rove\u0148 se uk\u00e1zalo, \u017ee ministerstvo vnitra nebylo schopno p\u0159im\u011bt ostatn\u00ed ministerstva k&nbsp;dostate\u010dn\u00e9 sou\u010dinnosti, co\u017e m\u016f\u017ee b\u00fdt jedn\u00edm z&nbsp;rizik nehierarchick\u00e9 koordinace ze stejn\u00e9 \u00farovn\u011b \u0159\u00edzen\u00ed. Posledn\u00ed d\u016fle\u017eitou charakteristikou je vysok\u00e1 m\u00edra konzultac\u00ed se&nbsp;zainteresovan\u00fdmi akt\u00e9ry, kter\u00e9 prob\u011bhly v&nbsp;11 p\u0159\u00edpadech z&nbsp;12 (Staro\u0148ov\u00e1 2010, s. 131).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hodnocen\u00ed p\u0159edkl\u00e1dan\u00fdch n\u00e1vrh\u016f z genderov\u00e9 perspektivy, identifikace a&nbsp;posouzen\u00ed jejich dopad\u016f na mu\u017ee a \u017eeny, a t\u00edm p\u00e1dem i re\u00e1ln\u00e1 mo\u017enost zabr\u00e1nit implementaci genderov\u011b diskriminuj\u00edc\u00edch, \u010di naopak p\u0159\u00edli\u0161 neutr\u00e1ln\u00edch legislativ, je sou\u010d\u00e1st\u00ed \u0161ir\u0161\u00ed strategie gender mainstreaming (GeM). Ta m\u00e1 za c\u00edl uplat\u0148ovat perspektivu rovnosti mu\u017e\u016f a \u017een a pevn\u011b ji integrovat do v\u0161ech koncep\u010dn\u00edch a&nbsp;rozhodovac\u00edch proces\u016f, a to na v\u0161ech \u00farovn\u00edch a ve v\u0161ech f\u00e1z\u00edch politik (Nov\u00e1kov\u00e1 2002). Vl\u00e1da \u010cR se k t\u00e9to strategii aktivn\u011b hl\u00e1s\u00ed sv\u00fdm souhlasem s&nbsp;<em>Pekingskou ak\u010dn\u00ed platformou<\/em>&nbsp;(ibid., s.&nbsp;29\u201330) a zavazuje se k&nbsp;jej\u00edmu pln\u011bn\u00ed od roku 2001 v&nbsp;ka\u017edoro\u010dn\u011b aktualizovan\u00fdch&nbsp;<em>Priorit\u00e1ch a postupech vl\u00e1dy p\u0159i prosazov\u00e1n\u00ed rovnosti mu\u017e\u016f a \u017een<\/em>&nbsp;(Vl\u00e1da \u010cR 2001).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na d\u016fle\u017eitost a povinnost hodnocen\u00ed dopad\u016f na rovnost je upozor\u0148ov\u00e1no zejm\u00e9na v&nbsp;souvislosti se zlep\u0161ov\u00e1n\u00edm institucion\u00e1ln\u00edho zabezpe\u010den\u00ed rovnosti \u017een a mu\u017e\u016f a zkvalit\u0148ov\u00e1n\u00ed legislativy sm\u011brem k&nbsp;ob\u011bma pohlav\u00edm (Vl\u00e1dn\u00ed strategie pro rovnost\u20262014). Konkr\u00e9tn\u011b \u010dinnostmi v&nbsp;r\u00e1mci projektu&nbsp;<em>Optimalizace institucion\u00e1ln\u00edho zabezpe\u010den\u00ed rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed \u017een a mu\u017e\u016f&nbsp;<\/em>(Optimalizace) je deklarov\u00e1na jak nutnost analyzovat podobu praxe hodnocen\u00ed dopad\u016f, tak i popt\u00e1vka po Metodice (\u00da\u0159ad vl\u00e1dy \u010cR2012). Nejen p\u0159i t\u011bchto aktivit\u00e1ch, ale zejm\u00e9na p\u0159i kontrole a tvorb\u011b potenci\u00e1ln\u00edch p\u0159ipom\u00ednek k&nbsp;hodnocen\u00ed hraje kl\u00ed\u010dovou roli Odd\u011blen\u00ed rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed (rovnosti) \u017een a mu\u017e\u016f (Odd\u011blen\u00ed). To v&nbsp;sou\u010dasnosti posiluje sv\u00e9 postaven\u00ed, je\u017e bylo doposud, zejm\u00e9na z&nbsp;d\u016fvodu \u010dast\u00fdch p\u0159esun\u016f agendy mezi MPSV a \u00da\u0159adem vl\u00e1dy \u010cR<a href=\"https:\/\/www.evaltep.cz\/inpage\/dopady-regulace-na-rovnost\/#_ftn2\"><sup>[2]<\/sup><\/a>&nbsp;a nedostate\u010dn\u00fdch person\u00e1ln\u00edch kapacit, sp\u00ed\u0161e vratk\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.1 Metodick\u00fd r\u00e1mec hodnocen\u00ed dopad\u016f regulace na rovnost mu\u017e\u016f a \u017een<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Metodick\u00fd r\u00e1mec hodnocen\u00ed dopad\u016f regulace na rovnost v \u010cR byl v&nbsp;obdob\u00ed prov\u00e1d\u011bn\u00ed anal\u00fdzy determinov\u00e1n t\u0159emi kl\u00ed\u010dov\u00fdmi dokumenty. T\u011bmi jsou Obecn\u00e9 z\u00e1sady pro hodnocen\u00ed dopad\u016f regulace (OZRIA), Legislativn\u00ed pravidla vl\u00e1dy (Legislativn\u00ed pravidla) a Jednac\u00ed \u0159\u00e1d vl\u00e1dy (Jednac\u00ed \u0159\u00e1d). Jmenovan\u00e9 dokumenty proch\u00e1zej\u00ed od roku 2007 ne sporadick\u00fdmi, a&nbsp;t\u00e9\u017e do jist\u00e9 m\u00edry problematick\u00fdmi, novelizacemi, je\u017e v\u00fdrazn\u011b upravuj\u00ed pr\u00e1v\u011b oblast hodnocen\u00ed dopad\u016f na rovnost. Na za\u010d\u00e1tku roku 2015 (tj.&nbsp;po&nbsp;proveden\u00ed na\u0161\u00ed anal\u00fdzy) byl tento r\u00e1mec roz\u0161\u00ed\u0159en o ji\u017e zm\u00edn\u011bnou Metodiku, kter\u00e1 d\u00e1v\u00e1 n\u00e1vod, jak hodnotit dopady ne\/legislativn\u00edch materi\u00e1l\u016f, a to specificky pouze na rovnost mu\u017e\u016f a \u017een. To v\u0161e s&nbsp;c\u00edlem zp\u0159ehlednit, zkvalitnit, ale i sjednotit proces hodnocen\u00ed (\u00da\u0159ad vl\u00e1dy \u010cR 2014).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V obdob\u00ed 2007\u20132011 OZRIA explicitn\u011b operuj\u00ed s&nbsp;koncepty rovnost pohlav\u00ed, soci\u00e1ln\u00ed rovnost\/spravedlnost a p\u0159\u00edmo na\u0159izuj\u00ed hodnotit dopady s&nbsp;ohledem na \u017eeny jako specifickou soci\u00e1ln\u00ed skupinu hodnou zv\u00fd\u0161en\u00e9 pozornosti (Obecn\u00e9 z\u00e1sady\u20262007). Konkr\u00e9tn\u00ed podobu hodnocen\u00ed a&nbsp;zm\u00edn\u011bn\u00e9 zm\u011bny lze nahl\u00e9dnout v&nbsp;tabulce \u010d. 2.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"530\" height=\"347\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/2-10.jpg\" alt=\"\" class=\"wp-image-815\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/2-10.jpg 530w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/2-10-300x196.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/2-10-115x75.jpg 115w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/2-10-480x314.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 530px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Uveden\u00e1 zm\u011bna byla relevantn\u00edmi akt\u00e9ry vn\u00edm\u00e1na p\u0159edev\u0161\u00edm negativn\u011b. \u010clenov\u00e9 V\u00fdboru pro institucion\u00e1ln\u00ed zabezpe\u010den\u00ed rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed \u017een a&nbsp;mu\u017e\u016f upozornili, \u017ee krok je v&nbsp;rozporu s doporu\u010den\u00edmi z\u00e1vazn\u00fdch mezin\u00e1rodn\u00edch dokument\u016f (Pekingsk\u00e1 ak\u010dn\u00ed platforma, doporu\u010den\u00ed V\u00fdboru ministr\u016f Rady Evropy CM\/Rec (2007) 17 atd.) a argumentovali, \u017ee genderov\u00e1 oblast je mnohem rozs\u00e1hlej\u0161\u00ed a slo\u017eit\u011bj\u0161\u00ed ne\u017e koncept (ne)diskriminace, kter\u00fd ji nedok\u00e1\u017ee obs\u00e1hnout v&nbsp;cel\u00e9 \u0161\u00ed\u0159i. Varovali, \u017ee&nbsp;hodnocen\u00ed dopad\u016f na rovnost mu\u017e\u016f a \u017een rozhodn\u011b nelze zam\u011bnit za&nbsp;hodnocen\u00ed na z\u00e1kaz diskriminace a vyj\u00e1d\u0159ili obavy nad faktick\u00fdm vymizen\u00edm povinnosti hodnotit dopady na rovnost (Z\u00e1znam ze&nbsp;dne 3. prosince 2013). \u00da\u0159ad vl\u00e1dy \u010cR argumentoval, \u017ee zm\u011bna je \u0159\u00edzena snahou o&nbsp;sjednocen\u00ed metodick\u00fdch n\u00e1stroj\u016f pro hodnocen\u00ed, tj. OZRIA a Legislativn\u00edch pravidel (podstata protich\u016fdnosti viz n\u00e1sleduj\u00edc\u00ed odstavec). Vznesen\u00ed p\u0159ipom\u00ednek v\u016f\u010di novele a snaha zachovat p\u016fvodn\u00ed hodnocen\u00ed rovnosti v\u0161ak nebyly \u00fasp\u011b\u0161n\u00e9, p\u0159i\u010dem\u017e podrobn\u011bj\u0161\u00ed zd\u016fvodn\u011bn\u00ed tohoto v\u00fdsledku nem\u00e1me k dispozici (Stanovisko&nbsp;MPSV\u20262013).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Probl\u00e9mov\u00e1 je nadto i protich\u016fdnost Legislativn\u00edch pravidel a OZRIA trvaj\u00edc\u00ed od listopadu 2012 do konce ledna 2014. V tomto obdob\u00ed byla v&nbsp;b\u011bhu&nbsp;novela Legislativn\u00edch pravidel, kter\u00e1 nebyla v souladu s po\u017eadavky vymezen\u00fdmi v OZRIA. Novelizovan\u00e1 Legislativn\u00ed pravidla po\u017eadovala hodnocen\u00ed dopad\u016f na&nbsp;z\u00e1kaz diskriminace, av\u0161ak OZRIA p\u016fvodn\u00ed dopady na rovnost. K ujednocen\u00ed pravidel do\u0161lo a\u017e novelou OZRIA platnou od \u00fanora roku 2014 (Legislativn\u00ed&nbsp;pravidla\u20262007, 2012; Obecn\u00e9 z\u00e1sady\u20262007, 2011, 2014).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.2 RIA v&nbsp;procesu evropeizace<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pro institucionalizaci a zakotven\u00ed n\u00e1stroje RIA do politik \u010dlensk\u00fdch st\u00e1t\u016f EU je st\u011b\u017eejn\u00edm proces evropeizace. Evropeizace p\u0159edstavuje proces evropsk\u00e9 integrace, jin\u00fdmi slovy dopady a efekty ve\u0161ker\u00fdch politik EU do&nbsp;n\u00e1rodn\u00edch politik \u010dlensk\u00fdch st\u00e1t\u016f a s&nbsp;t\u00edmto spojen\u00e9 zm\u011bny (T\u00f6ller 2004, s.&nbsp;1; Zemanov\u00e1 2007,&nbsp;s.&nbsp;32). Evropeizace v&nbsp;sob\u011b poj\u00edm\u00e1 n\u011bkolik rovin, p\u0159i\u010dem\u017e pro tento \u010dl\u00e1nek jsou relevantn\u00ed zejm\u00e9na rovina legislativn\u00ed (p\u0159ej\u00edm\u00e1n\u00ed norem EU, p\u0159izp\u016fsobov\u00e1n\u00ed n\u00e1rodn\u00edch legislativ), \u010dlensk\u00fdch st\u00e1t\u016f (implementace a evaluace politik EU, zm\u011bny v&nbsp;n\u00e1rodn\u00ed policy, polity, politics) a EU (formov\u00e1n\u00ed a posilov\u00e1n\u00ed politick\u00e9ho syst\u00e9mu EU) (Dan\u010d\u00e1k, Fiala, Hlou\u0161ek 2005, s. 14). Kl\u00ed\u010dovou je i reakce politik na samotnou evropeizaci, kter\u00e1 se vyskytuje v&nbsp;n\u00e1sleduj\u00edc\u00edch form\u00e1ch. Jedn\u00e1 se o&nbsp;\u201eabsorpci\u201c (p\u0159izp\u016fsoben\u00ed se politick\u00fdch n\u00e1rok\u016fm, ov\u0161em pouze \u201enaoko\u201c, bez podstatn\u00e9 zm\u011bny ve struktur\u00e1ch a politick\u00e9m chov\u00e1n\u00ed), \u201etransformaci\u201c (skute\u010dn\u00e1 adaptace na politick\u00e9 n\u00e1roky, re\u00e1ln\u00e1 zm\u011bna), lhostejnost (rezistence k&nbsp;politick\u00fdm n\u00e1rok\u016fm, absence zm\u011bny) a \u201esta\u017een\u00ed se\u201c (odvr\u00e1cen\u00ed se&nbsp;k&nbsp;p\u016fvodn\u00edm&nbsp;m\u00e9n\u011b evropeizovan\u00fdm \u0159e\u0161en\u00edm, absence zm\u011bny) (Radaelli citov\u00e1n in Dan\u010d\u00e1k 2006, s. 79).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na \u00farovni EU jsou pro integraci RIA ve \u010dlensk\u00fdch st\u00e1tech st\u011b\u017eejn\u00ed zejm\u00e9na aktivita Evropsk\u00e9 komise pro inteligentn\u00ed regulaci a pokyny pro zlep\u0161ov\u00e1n\u00ed regulace, je\u017e z\u00e1rove\u0148 p\u0159edstavuj\u00ed jeden z d\u00edl\u010d\u00edch c\u00edl\u016f Strategie Evropa 2020. Zlep\u0161ov\u00e1n\u00ed regulace je t\u00e9\u017e kl\u00ed\u010dov\u00fdm p\u0159i pln\u011bn\u00ed c\u00edl\u016f Lisabonsk\u00e9 strategie (Strategie zlep\u0161ov\u00e1n\u00ed\u20262006). Pro oblast rovnosti mu\u017e\u016f a \u017een je pak ji\u017e od roku 2003 doporu\u010dov\u00e1n Gender Impact Assessment, kter\u00fd je jedn\u00edm z&nbsp;n\u00e1stroj\u016f strategie GeM s&nbsp;re\u00e1ln\u00fdm potenci\u00e1lem p\u0159ezkoumat regulace dle&nbsp;genderov\u00e9ho charakteru a p\u0159edch\u00e1zet implementaci genderov\u011b diskriminuj\u00edc\u00ed \u010di p\u0159\u00edli\u0161n\u011b neutr\u00e1ln\u00ed regulace (EC 2014; Nov\u00e1kov\u00e1 2002).<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li><strong>Metody a analytick\u00fd n\u00e1stroj<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Pro zodpov\u011bzen\u00ed v\u00fdzkumn\u00fdch ot\u00e1zek byl zvolen v\u00fdzkumn\u00fd p\u0159\u00edstup evaluace. Evaluace je metodologi\u00ed \u010di technikou soci\u00e1ln\u011b-v\u011bdn\u00edho v\u00fdzkumu maj\u00edc\u00ed za c\u00edl systematick\u00fdm a formalizovan\u00fdm zp\u016fsobem analyzovat a&nbsp;hodnotit efektivitu ur\u010dit\u00fdch soci\u00e1ln\u011b-interven\u010dn\u00edch program\u016f (Rossi, Lipsey, Freeman 2004). Oblast aplikace nen\u00ed redukov\u00e1na pouze na efektivitu, n\u00fdbr\u017e i na dal\u0161\u00ed integr\u00e1ln\u00ed dimenze intervenc\u00ed jako je u\u017eite\u010dnost, implementace, napl\u0148ov\u00e1n\u00ed c\u00edl\u016f, dopady a v\u00fdsledky (Nekola 2007). Evaluace je vysoce cen\u011bnou zejm\u00e9na d\u00edky sv\u00e9mu potenci\u00e1lu p\u0159in\u00e1\u0161et objektivn\u00ed a&nbsp;prakticky vyu\u017eitelnou zp\u011btnou vazbu kl\u00ed\u010dov\u00fdm akt\u00e9r\u016fm, a t\u00edm re\u00e1ln\u011b dopom\u00e1hat ke zvy\u0161ov\u00e1n\u00ed kvality a efektivity intervenc\u00ed a ur\u010dovat sm\u011br jejich dal\u0161\u00edho v\u00fdvoje (Patton 2008).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u00fdzkumn\u00fd p\u0159\u00edstup u\u017e\u00edvan\u00fd pro pot\u0159eby tohoto \u010dl\u00e1nku je d\u00e1le specifikov\u00e1n jako evaluace ex-post, technika nastupuj\u00edc\u00ed v&nbsp;z\u00e1v\u011bre\u010dn\u00e9 f\u00e1zi cyklu, tj.&nbsp;po implementaci dan\u00e9 intervence. Zm\u00edn\u011bn\u00fd potencion\u00e1ln\u00ed eduka\u010dn\u00ed charakter evaluace je v&nbsp;tomto ohledu siln\u011b p\u0159\u00edtomen a p\u0159\u00edmo souvis\u00ed s&nbsp;p\u0159\u00edpadnou tvorbou intervenc\u00ed nov\u00fdch (Greenberg 2010).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pro porozum\u011bn\u00ed aplikovan\u00e9mu v\u00fdzkumn\u00e9mu p\u0159\u00edstupu je postoupeno je\u0161t\u011b o \u00farove\u0148 n\u00ed\u017ee k evalua\u010dn\u00edm technik\u00e1m konstruovan\u00fdch p\u0159\u00edmo pro RIA. Harrington, Morgenstern (2004) vymezuj\u00ed t\u0159i z\u00e1kladn\u00ed sm\u011bry evaluace c\u00edlen\u00e9 na testov\u00e1n\u00ed obsahu, v\u00fdstup\u016f a funkce RIA. Pro \u00fa\u010dely t\u00e9to pr\u00e1ce je aplikovateln\u00fdm zejm\u00e9na prvn\u00ed uveden\u00fd sm\u011br (testov\u00e1n\u00ed obsahu), je\u017e&nbsp;dle&nbsp;autor\u016f prim\u00e1rn\u011b zji\u0161\u0165uje m\u00edru pln\u011bn\u00ed form\u00e1ln\u00edch po\u017eadavk\u016f definovan\u00fdch v&nbsp;ofici\u00e1ln\u00edch z\u00e1sad\u00e1ch pro prov\u00e1d\u011bn\u00ed hodnocen\u00ed. Toto\u017en\u00fd c\u00edl sleduje evalua\u010dn\u00ed p\u0159\u00edstup Hahn et al. (2000) pracuj\u00edc\u00ed na principu&nbsp;<em>scorecard(ing)<\/em>. P\u0159\u00edstup, u\u017e\u00edvan\u00fd p\u0159edev\u0161\u00edm pro evaluaci hodnocen\u00ed dopad\u016f ekonomick\u00fdch, na z\u00e1klad\u011b anal\u00fdzy v\u0161ech polo\u017eek ze seznamu (formulovan\u00fdch dle po\u017eadavk\u016f ofici\u00e1ln\u00edch pravidel pro hodnocen\u00ed) stanovuje v\u00fdsledn\u00e9 sk\u00f3re, je\u017e by m\u011blo vypov\u00eddat o kvalit\u011b RIA (Cecot et al. 2008; Hahn et al. 2000; Hahn, Dudley 2007). Inspirac\u00ed pro zkonstruov\u00e1n\u00ed evalua\u010dn\u00edho n\u00e1stroje pro tento \u010dl\u00e1nek byly i evaluace RIA realizovan\u00e9 Staro\u0148ovou (2007, 2010), kter\u00e1 vych\u00e1zela z&nbsp;princip\u016f veden\u00ed evaluace dle ji\u017e zm\u00edn\u011bn\u00fdch Hahn et al. (2000) \u010di Rendy (2006) a Zubeka (2007). Jen s&nbsp;t\u00edm rozd\u00edlem, \u017ee&nbsp;c\u00edlila p\u0159edev\u0161\u00edm na identifikaci p\u0159\u00edtomnosti ur\u010dit\u00e9ho typu informace a&nbsp;indik\u00e1tor\u016f vypov\u00eddaj\u00edc\u00edch o obsahu a kvalit\u011b t\u00e9to informace (Staro\u0148ov\u00e1 2010). Zji\u0161t\u011bn\u00ed Staro\u0148ov\u00e9 poslou\u017eila i jako z\u00e1klad pro strukturaci n\u00e1sleduj\u00edc\u00ed \u010d\u00e1sti \u010dl\u00e1nku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na z\u00e1klad\u011b sezn\u00e1men\u00ed se s evalua\u010dn\u00edmi metodami pro RIA byl vytvo\u0159en vlastn\u00ed evalua\u010dn\u00ed n\u00e1stroj (viz P\u0159\u00edloha \u010d. 1). Ten sest\u00e1v\u00e1 ze dvou okruh\u016f obsahuj\u00edc\u00edch hodnot\u00edc\u00ed parametry. Tvorba parametr\u016f byla prim\u00e1rn\u011b pod\u0159\u00edzena v\u00fdzkumn\u00fdm ot\u00e1zk\u00e1m a definovan\u00fdm po\u017eadavk\u016fm z pravidel metodick\u00fdch n\u00e1stroj\u016f pro tvorbu hodnocen\u00ed (OZRIA, Legislativn\u00ed pravidla). Sekund\u00e1rn\u011b jsme vych\u00e1zely z&nbsp;nastudovan\u00e9ho v\u011bd\u011bn\u00ed o strategii GeM a&nbsp;oblastech gender a genderov\u00e1 rovnost.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">S&nbsp;c\u00edlem zachytit \u010deskou praxi hodnocen\u00ed perspektivou p\u0159\u00edm\u00fdch zku\u0161enost\u00ed odborn\u00edk\u016f z&nbsp;praxe, a triangulovat tak zji\u0161t\u011bn\u00ed evaluace, bylo vyu\u017eito dal\u0161\u00ed v\u00fdzkumn\u00e9 metody, a to expertn\u00edch rozhovor\u016f. Uskute\u010dn\u011bny byly celkem dva rozhovory a informa\u010dn\u00ed partner a partnerky byli vybr\u00e1ni na z\u00e1klad\u011b \u00fasudku (Je\u0159\u00e1bek 1993, s. 50). Prvn\u00ed rozhovor byl proveden s&nbsp;genderovou expertkou a b\u00fdvalou pracovnic\u00ed Odd\u011blen\u00ed, druh\u00fd pak se dv\u011bma sou\u010dasn\u00fdmi zam\u011bstnanci Odd\u011blen\u00ed.&nbsp;A\u010dkoli vybran\u00ed experti sd\u00edlej\u00ed svou profesn\u00ed orientaci\/z\u00e1zem\u00ed, jejich p\u016fsoben\u00ed ov\u0161em spad\u00e1 do r\u016fzn\u00fdch \u010dasov\u00fdch obdob\u00ed v\u00fdvoje Odd\u011blen\u00ed (agenda jak pod MPSV, tak \u00da\u0159adem vl\u00e1dy \u010cR). D\u00edky tomuto jsou schopni reflektovat cel\u00e9 vybran\u00e9 \u010dasov\u00e9 obdob\u00ed procesu RIA na rovnost mu\u017e\u016f a \u017een, a to jednak z&nbsp;hlediska \u010dinnosti tak kl\u00ed\u010dov\u00e9ho org\u00e1nu jako je Odd\u011blen\u00ed, jednak podoby konkr\u00e9tn\u00edch v\u00fdstup\u016f.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.1 V\u00fdb\u011brov\u00fd soubor legislativn\u00edch dokument\u016f<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u00fdb\u011brov\u00fd soubor je slo\u017een z n\u00e1vrh\u016f pr\u00e1vn\u00edch p\u0159edpis\u016f (tj. legislativn\u00edch materi\u00e1l\u016f p\u0159edkl\u00e1dan\u00fdch vl\u00e1d\u011b), konkr\u00e9tn\u011b v\u00fdstup\u016f z&nbsp;hodnocen\u00ed dle Legislativn\u00edch pravidel, tj. d\u016fvodov\u00e9 zpr\u00e1vy a v\u00fdstup\u016f z&nbsp;RIA, tj. z\u00e1v\u011bre\u010dn\u00e9 zpr\u00e1vy z hodnocen\u00ed dopad\u016f regulace. Do anal\u00fdzy vstupuj\u00ed ve\u0161ker\u00e9 druhy n\u00e1vrh\u016f pr\u00e1vn\u00edch p\u0159edpis\u016f podl\u00e9haj\u00edc\u00ed nutnosti hodnocen\u00ed, tj. v\u011bcn\u00e9 z\u00e1m\u011bry z\u00e1kon\u016f, z\u00e1kony, na\u0159\u00edzen\u00ed a vyhl\u00e1\u0161ky. Dal\u0161\u00edmi podm\u00ednkami vstupu do&nbsp;v\u00fdb\u011brov\u00e9ho souboru bylo datum zve\u0159ejn\u011bn\u00ed a tv\u016frce\/p\u0159edkladatel n\u00e1vrhu. N\u00e1vrh musel spadat do vymezen\u00e9ho \u010dasov\u00e9ho obdob\u00ed mezi 1. z\u00e1\u0159\u00edm 2007 (od listopadu 2007 povinnost prov\u00e1d\u011bt RIA) a\u017e 10. dubnem 2014 (od&nbsp;\u00fanora 2014 platn\u00e1 novela OZRIA) a b\u00fdt vytvo\u0159en jedn\u00edm z n\u00e1sleduj\u00edc\u00edch ministerstev \u2013 Ministerstvo pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed (MPSV), Ministerstvo vnitra (MV) a Ministerstvo zdravotnictv\u00ed&nbsp;(MZd).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u00fdb\u011br ministerstev byl prov\u00e1d\u011bn \u00fasudkem, k&nbsp;n\u011bmu\u017e se, vzhledem k dostate\u010dn\u00e9 obezn\u00e1menosti s t\u00e9matem, c\u00edt\u00edme b\u00fdt opr\u00e1vn\u011bny (Je\u0159\u00e1bek 1993,&nbsp;s.&nbsp;50). MPSV bylo zvoleno z&nbsp;d\u016fvodu t\u011bsn\u00e9 sepjatosti s&nbsp;genderovou problematikou a hodnocen\u00edm dopad\u016f na rovnost (aktivn\u00ed p\u0159\u00edstup k prosazov\u00e1n\u00ed rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed \u017een a mu\u017e\u016f; snaha reflektovat genderov\u00fd rozm\u011br ve zd\u00e1nliv\u011b neutr\u00e1ln\u00edch p\u0159edpisech \u2013 Pavl\u00edk et al. 2008, s. 13, 35). O\u010dek\u00e1v\u00e1na t\u00e9\u017e byla vysok\u00e1 genderovanost n\u00e1vrh\u016f MPSV. Tento aspekt byl rozhoduj\u00edc\u00edm takt\u00e9\u017e p\u0159i v\u00fdb\u011bru MZd. P\u0159edpokl\u00e1dan\u00e1 vysok\u00e1 kvalita zpracov\u00e1n\u00ed n\u00e1vrh\u016f, je\u017e se odv\u00edj\u00ed nejenom od siln\u00e9 zainteresovanosti do&nbsp;procesu RIA (srov. Staro\u0148ov\u00e1 2010), ale i pln\u011bn\u00ed po\u017eadavk\u016f na rovn\u00e9 p\u0159\u00edle\u017eitosti, vedla k&nbsp;za\u0159azen\u00ed MV (ibid., s. 13). V\u00fdb\u011br byl pod\u0159\u00edzen i snaze volit rezorty dostate\u010dn\u011b odli\u0161n\u00e9, v&nbsp;n\u00e1vrz\u00edch zac\u00edlen\u00e9 do r\u016fzn\u00fdch oblast\u00ed. To v\u0161e s&nbsp;viz\u00ed, \u017ee bude dosa\u017eeno v\u00fdsledk\u016f nejenom reprezentativn\u00edch, ale&nbsp;i&nbsp;variabiln\u00edch a demonstruj\u00edc\u00edch jak pravidelnosti, tak jedine\u010dnosti procesu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fin\u00e1ln\u00ed po\u010det n\u00e1vrh\u016f nebyl p\u0159edem ur\u010den, a tud\u00ed\u017e nikterak kr\u00e1cen dal\u0161\u00edm v\u00fdb\u011brem. Za \u00fa\u010delem nabyt\u00ed r\u016fznorod\u00fdch informac\u00ed, vylou\u010den\u00ed nahodilost\u00ed, odhalen\u00ed pravidelnost\u00ed a u\u010din\u011bn\u00ed v\u00fdb\u011bru maxim\u00e1ln\u011b reprezentativn\u00edm byl do souboru za\u0159azen ka\u017ed\u00fd jeden n\u00e1vrh pr\u00e1vn\u00edho p\u0159edpisu spl\u0148uj\u00edc\u00ed v\u00fd\u0161e stanoven\u00e9 podm\u00ednky, a to v&nbsp;podob\u011b\/f\u00e1zi nejaktu\u00e1ln\u011bj\u0161\u00ed k&nbsp;datu prov\u00e1d\u011bn\u00ed evaluace (b\u0159ezen 2014). Nutno je tak br\u00e1t v&nbsp;\u00favahu, \u017ee z&nbsp;d\u016fvodu posloupnosti f\u00e1z\u00ed legislativn\u00edho procesu mohlo u n\u011bkter\u00fdch n\u00e1vrh\u016f n\u00e1sledn\u011b, po&nbsp;n\u00e1mi proveden\u00e9 evaluaci, hypoteticky doj\u00edt k&nbsp;\u00faprav\u011b podoby jejich hodnocen\u00ed. Konkr\u00e9tn\u00ed rozlo\u017een\u00ed celkov\u00fdch 236 n\u00e1vrh\u016f mezi jednotliv\u00e1 ministerstva je n\u00e1sleduj\u00edc\u00ed \u2013 MPSV 78, MV 92 a MZd 66 n\u00e1vrh\u016f. Ka\u017ed\u00fd ro\u010dn\u00ed soubor od jednoho ministerstva tak \u010d\u00edt\u00e1 minim\u00e1ln\u011b dva a maxim\u00e1ln\u011b 20 n\u00e1vrh\u016f, a to v\u017edy se zastoupen\u00edm alespo\u0148 dvou rozd\u00edln\u00fdch druh\u016f p\u0159edpis\u016f.<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\">\n<li><strong>\u010cesk\u00e1 praxe hodnocen\u00ed dopad\u016f regulace na rovnost mu\u017e\u016f a&nbsp;\u017een<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Tato \u010d\u00e1st p\u0159edstavuje samotn\u00e9 v\u00fdsledky z&nbsp;evaluace a je strukturov\u00e1na tak, aby jednak potenci\u00e1ln\u011b nov\u011b nasv\u00edtila n\u011bkter\u00e1 ze zji\u0161t\u011bn\u00ed Staro\u0148ov\u00e9, a z\u00e1rove\u0148 poskytla odpov\u011b\u010f na dal\u0161\u00ed v\u00fdzkumn\u00e9 ot\u00e1zky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.1 Vztah hodnocen\u00ed dopad\u016f na rovnost mu\u017e\u016f a \u017een k&nbsp;metodick\u00e9mu r\u00e1mci RIA<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prvn\u00ed podkapitola se zab\u00fdv\u00e1 (ne)souladem hodnocen\u00ed dopad\u016f na rovnost mu\u017e\u016f a \u017een s&nbsp;metodick\u00fdm r\u00e1mcem RIA a podobou u\u017e\u00edv\u00e1n\u00ed jednotliv\u00fdch pravidel (OZRIA, Legislativn\u00ed pravidla vl\u00e1dy).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Typickou charakteristikou \u010desk\u00e9 praxe RIA u vybran\u00fdch ministerstev je \u010dast\u00fd nesoulad s&nbsp;metodick\u00fdm r\u00e1mcem, a to konkr\u00e9tn\u011b absence hodnocen\u00ed n\u011bkter\u00fdch dopad\u016f (nejenom dopady na rovnost), od\u016fvodn\u011bn\u00ed samotn\u00e9ho hodnocen\u00ed a spojov\u00e1n\u00ed hodnocen\u00ed v\u00edce dopad\u016f v r\u00e1mci&nbsp;jedn\u00e9 \u010d\u00e1sti, nadto \u010dasto titulovan\u00e9 nespr\u00e1vn\u00fdm n\u00e1zvem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z&nbsp;v\u00fdsledk\u016f evaluace vypl\u00fdv\u00e1, \u017ee p\u0159\u00edtomnost jak\u00e9hokoli od\u016fvodn\u011bn\u00ed a&nbsp;vysv\u011btlen\u00ed dan\u00e9ho hodnocen\u00ed, kter\u00e9 je explicitn\u00edm po\u017eadavkem pravidel, je zanedbateln\u00e1, a to u v\u0161ech ministerstev bez rozd\u00edlu. Praxe MPSV ukazuje, \u017ee ur\u010dit\u00e1 forma od\u016fvodn\u011bn\u00ed je p\u0159\u00edtomna u&nbsp;deseti hodnocen\u00ed ze&nbsp;78, u MZ v sedmi p\u0159\u00edpadech z&nbsp;92 a ve v\u00fdstupech MZd je tomu tak u p\u011bti p\u0159\u00edpad\u016f z&nbsp;66. Typick\u00e9 od\u016fvodn\u011bn\u00ed spo\u010d\u00edv\u00e1 v popisu podoby n\u00e1vrhu, tj. jak\u00fd n\u00e1vrh je\/nen\u00ed nebo co \u010din\u00ed\/ne\u010din\u00ed. V&nbsp;minim\u00e1ln\u00ed m\u00ed\u0159e se vyskytuje popis o\u010dek\u00e1van\u00e9ho v\u00fdvoje a stavu po zaveden\u00ed n\u00e1vrhu. Velice \u010dast\u00e9 je t\u00e9\u017e stroh\u00e9 odk\u00e1zan\u00ed na relevantn\u00ed legislativy, m\u00e9n\u011b \u010dasto pak slou\u017e\u00ed jako opora pro tvrzen\u00ed data a statistiky vztahuj\u00edc\u00ed se k&nbsp;genderov\u00e9 problematice. Obdobn\u00e1 je situace i v&nbsp;p\u0159\u00edpad\u011b doporu\u010dovan\u00fdch konzultac\u00ed s&nbsp;relevantn\u00edmi akt\u00e9ry. Je zji\u0161t\u011bno, \u017ee ty jsou velmi sporadick\u00e9. U MPSV prob\u011bhla konzultace s akt\u00e9ry, alespo\u0148 minim\u00e1ln\u011b spojen\u00fdmi s genderovou t\u00e9matikou, ve t\u0159ech p\u0159\u00edpadech, u MV ani jednou a MZd v&nbsp;jednom p\u0159\u00edpad\u011b. U MPSV se jednalo o&nbsp;konzultaci se Sekc\u00ed pro lidsk\u00e1 pr\u00e1va, Kancel\u00e1\u0159\u00ed ve\u0159ejn\u00e9ho ochr\u00e1nce pr\u00e1v, V\u00fdborem&nbsp;pro slad\u011bn\u00ed pracovn\u00edho, soukrom\u00e9ho a rodinn\u00e9ho \u017eivota a Radou vl\u00e1dy pro rovn\u00e9 p\u0159\u00edle\u017eitosti. U MZd prob\u011bhla konzultace se Sexuologickou spole\u010dnost\u00ed a \u010ceskou gynekologicko-porodnickou spole\u010dnost\u00ed. Ani v&nbsp;jednou p\u0159\u00edpad\u011b nebyly v\u00fdstupy z&nbsp;konzultac\u00ed u\u017eity jako opora pro argumentaci.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na praxi spojov\u00e1n\u00ed hodnocen\u00ed v\u00edce dopad\u016f prim\u00e1rn\u011b upozor\u0148uje ji\u017e role, kterou samotn\u00e1 hodnot\u00edc\u00ed formulace zauj\u00edm\u00e1 v&nbsp;r\u00e1mci textu. Jak dokl\u00e1d\u00e1 tabulka \u010d. 3, t\u00e9m\u011b\u0159 polovina ze v\u0161ech&nbsp;236 formulac\u00ed se nach\u00e1z\u00ed jako d\u00edl\u010d\u00ed objekt uvnit\u0159&nbsp;\u010d\u00e1sti, ve kter\u00e9 by dle pravidel b\u00fdt nem\u011bla a \u010d\u00e1sti, je\u017e je tematicky \u010dasto vzd\u00e1lena rovnosti \u017een a mu\u017e\u016f.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"565\" height=\"172\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/3-8.jpg\" alt=\"\" class=\"wp-image-817\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/3-8.jpg 565w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/3-8-300x91.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/3-8-150x46.jpg 150w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/3-8-480x146.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 565px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Pokud se hodnocen\u00ed dopad\u016f na rovnost skute\u010dn\u011b nach\u00e1z\u00ed uvnit\u0159 ciz\u00ed \u010d\u00e1sti, tj. je prov\u00e1z\u00e1no s&nbsp;dopady ostatn\u00edmi, vytv\u00e1\u0159\u00ed s nimi n\u00e1sleduj\u00edc\u00ed tzv. synt\u00e9zy (viz tabulka \u010d. 4). Hojn\u00e9 spojov\u00e1n\u00ed hodnocen\u00ed v\u00edce r\u016fzn\u00fdch dopad\u016f v r\u00e1mci jedn\u00e9 formulace lze vid\u011bt jako problematick\u00e9 zejm\u00e9na z d\u016fvodu nesouladu t\u00e9to praxe s&nbsp;metodick\u00fdm r\u00e1mcem \u010di omezen\u00ed prostoru pro jednotliv\u00e9 dopady. S&nbsp;t\u00edmto souvis\u00ed i ni\u017e\u0161\u00ed vizu\u00e1ln\u00ed rozpoznatelnost dopadu na rovnost v&nbsp;r\u00e1mci textu, pota\u017emo sn\u00ed\u017een\u00e1 d\u016fle\u017eitost, pozornost, je\u017e je mu v\u011bnov\u00e1na. Jedna z expertek sice uv\u00e1d\u00ed, \u017ee na jednu stranu je t\u00e9ma rovnosti mu\u017e\u016f a \u017een pr\u016f\u0159ezov\u00e9 a souvis\u00ed s&nbsp;n\u011bkter\u00fdmi hodnocen\u00fdmi dopady (soci\u00e1ln\u00ed \u010di p\u0159\u00edpadn\u011b i ekonomick\u00e9 a podnikatelsk\u00e9), na stranu druhou v\u0161ak varuje, \u017ee ne ve v\u0161ech p\u0159\u00edpadech, zejm\u00e9na u&nbsp;dopad\u016f p\u0159\u00edmo souvisej\u00edc\u00edch s&nbsp;postaven\u00edm fyzick\u00fdch osob, je synt\u00e9za p\u0159\u00ednosem. Ministerstvem, kter\u00e9 nej\u010dast\u011bji zm\u00edn\u011bnou praxi provozuje je MZd (nadpolovi\u010dn\u00ed v\u011bt\u0161ina p\u0159\u00edpad\u016f); synt\u00e9z\u00e1m se naopak nejv\u00edce sna\u017e\u00ed vyh\u00fdbat MPSV (jedna p\u011btina ze v\u0161ech p\u0159\u00edpad\u016f).<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"540\" height=\"278\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/4-8.jpg\" alt=\"\" class=\"wp-image-819\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/4-8.jpg 540w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/4-8-300x154.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/4-8-146x75.jpg 146w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/4-8-480x247.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 540px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">V&nbsp;n\u00e1vaznosti na p\u0159edchoz\u00ed je t\u0159eba upozornit, \u017ee nesoulad s&nbsp;metodick\u00fdm r\u00e1mcem se \u010dasto t\u00fdk\u00e1 i n\u00e1zvu \u010d\u00e1sti, do kter\u00e9 je za\u0159azena hodnot\u00edc\u00ed formulace. Z&nbsp;v\u00fdsledk\u016f vypl\u00fdv\u00e1, \u017ee nap\u0159\u00ed\u010d v\u0161emi ministerstvy je v 58 % p\u0159\u00edpad\u016f formulace za\u0159azena do \u010d\u00e1sti, jej\u00ed\u017e n\u00e1zev zcela neu\u017e\u00edv\u00e1 term\u00edn\u016f rovnost mu\u017e\u016f a \u017een\/z\u00e1kaz diskriminace, soci\u00e1ln\u00ed&nbsp;dopady. To m\u016f\u017ee odkazovat na&nbsp;ji\u017e zm\u00edn\u011bnou praxi spojov\u00e1n\u00ed hodnocen\u00ed v\u00edce dopad\u016f a v&nbsp;d\u016fsledku znamenat zneviditel\u0148ov\u00e1n\u00ed vybran\u00e9 agendy. Za kl\u00ed\u010dov\u00fd vzorec \u010desk\u00e9 praxi opakuj\u00edc\u00ed se u v\u0161ech ministerstev lze ozna\u010dit netitulov\u00e1n\u00ed \u010d\u00e1sti poj\u00edmaj\u00edc\u00ed formulaci \u017e\u00e1dn\u00fdm n\u00e1zvem. Ministerstvem, kter\u00e9 tento p\u0159\u00edstup nej\u010dast\u011bji uplat\u0148uje, a to v\u00edce jak u poloviny n\u00e1vrh\u016f, je MZd. Naopak MV se tohoto vyst\u0159\u00edh\u00e1v\u00e1, a nadto dle vzoru metodick\u00e9ho r\u00e1mce \u010dasto umis\u0165uje (18 p\u0159\u00edpad\u016f) pod n\u00e1zev&nbsp;<em>dopad na\/ve vztahu k rovnost(i) mu\u017e\u016f a \u017een.<\/em>&nbsp;Op\u011btovn\u011b v\u0161echna ministerstva velice \u010dasto za\u0159azuj\u00ed hodnocen\u00ed v\u00edce druh\u016f dopad\u016f pod jeden spole\u010dn\u00fd n\u00e1zev (souvis\u00ed se spojov\u00e1n\u00edm dopad\u016f i v samotn\u00fdch hodnot\u00edc\u00edch formulac\u00edch \u2013 viz tab. \u010d. 4).<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"549\" height=\"476\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/5-7.jpg\" alt=\"\" class=\"wp-image-821\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/5-7.jpg 549w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/5-7-300x260.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/5-7-87x75.jpg 87w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/5-7-480x416.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 549px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Naopak soulad lze zaznamenat ve struktu\u0159e hodnocen\u00ed, konkr\u00e9tn\u011b um\u00edst\u011bn\u00ed hodnot\u00edc\u00ed formulace v&nbsp;r\u00e1mci cel\u00e9ho n\u00e1vrhu. V\u00fdsledky ukazuj\u00ed, \u017ee&nbsp;nap\u0159\u00ed\u010d v\u0161emi ministerstvy hodnot\u00edc\u00ed formulace je, v&nbsp;souladu s metodick\u00fdm r\u00e1mcem, nej\u010dast\u011bji situov\u00e1na v&nbsp;z\u00e1v\u011bru textu (66&nbsp;%), n\u00e1sledn\u011b ve st\u0159edu (26 %) a v&nbsp;minim\u00e1ln\u00edm mno\u017estv\u00ed p\u0159\u00edpad\u016f na&nbsp;za\u010d\u00e1tku (8&nbsp;%).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159i sledov\u00e1n\u00ed nakl\u00e1d\u00e1n\u00ed s jednotliv\u00fdmi pravidly pro tvorbu RIA je \u010dasto zachyceno u\u017e\u00edv\u00e1n\u00ed obou metodick\u00fdch n\u00e1stroj\u016f v&nbsp;r\u00e1mci jednoho n\u00e1vrhu. V&nbsp;na\u0161em v\u00fdzkumn\u00e9m vzorku je identifikov\u00e1no u\u017e\u00edv\u00e1n\u00ed Legislativn\u00edch pravidel, OZRIA \u010di tzv. \u201ehybridn\u00ed\u201c kombinace dvou p\u0159edchoz\u00edch pravidel (ozna\u010deno OZRIA+LPV). Lze tak \u0159\u00edci, \u017ee u 39 % z&nbsp;236 n\u00e1vrh\u016f doch\u00e1z\u00ed ke&nbsp;kombinov\u00e1n\u00ed po\u017eadavk\u016f jak z&nbsp;Legislativn\u00edch pravidel, tak OZRIA, a&nbsp;to&nbsp;v&nbsp;r\u00e1mci jednoho v\u00fdstupu. Ukazuje se, \u017ee nap\u0159\u00ed\u010d v\u0161emi n\u00e1vrhy dominuje n\u011bkolik m\u00e1lo st\u00e1le se opakuj\u00edc\u00edch formulac\u00ed, co\u017e lze vzhledem k&nbsp;absenci metodiky, kter\u00e1 by opakov\u00e1n\u00ed formulac\u00ed vysv\u011btlovala a ospravedl\u0148ovala, interpretovat jako doklad mechanick\u00e9 a formalistn\u00ed praxe hodnocen\u00ed.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"540\" height=\"207\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/7-6.jpg\" alt=\"\" class=\"wp-image-825\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/7-6.jpg 540w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/7-6-300x115.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/7-6-150x58.jpg 150w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/7-6-480x184.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 540px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Za problematick\u00e9 z&nbsp;hlediska souladu s&nbsp;pravidly lze u formulace dominuj\u00edc\u00ed u MPSV \u2013&nbsp;<em>n\u00e1vrh je neutr\u00e1ln\u00ed<\/em>&nbsp;(34 ze 78) \u2013 ozna\u010dit absenci \u00fast\u0159edn\u00edho term\u00ednu dopad. Formulace popisuje pouze to, jak\u00fd n\u00e1vrh je na oblast rovnosti\/diskriminace, a opom\u00edj\u00ed tak hodnocen\u00ed toho, jak\u00fd je konkr\u00e9tn\u00ed dopad. Distancuje se od vymezen\u00e9ho c\u00edle, a nadto se dost\u00e1v\u00e1 do rozporu s&nbsp;metodick\u00fdmi n\u00e1stroji. Z\u00e1rove\u0148 m\u016f\u017ee u\u017eit\u00ed term\u00ednu&nbsp;<em>neutr\u00e1ln\u00ed<\/em>&nbsp;odkazovat na znalost doporu\u010den\u00e9 \u0161k\u00e1ly hodnocen\u00ed (dopad pozitivn\u00ed, negativn\u00ed, neutr\u00e1ln\u00ed; dle Odd\u011blen\u00ed rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed \u017een a mu\u017e\u016f). Pouze povrchn\u00ed znalost genderov\u00e9 problematiky a hypoteticky \u00fa\u010delov\u00e9 a strategick\u00e9 nakl\u00e1d\u00e1n\u00ed s&nbsp;odborn\u00fdmi pojmy ze strany tv\u016frce lze sledovat u formulace \u201e<em>\u2026\u00faprava nezakl\u00e1d\u00e1 p\u0159\u00edmou ani nep\u0159\u00edmou diskriminaci mu\u017e\u016f \u010di \u017een, m\u00e1 stejn\u00fd dopad na ob\u011b pohlav\u00ed, a je tud\u00ed\u017e genderov\u011b neutr\u00e1ln\u00ed<\/em>.\u201c (n\u00e1vrh z\u00e1kona o nemocensk\u00e9m poji\u0161t\u011bn\u00ed\u2026, 2007, s. 43). Nelze pop\u0159\u00edt, \u017ee formulace je v&nbsp;souladu s&nbsp;pravidly a&nbsp;zohled\u0148uje jak perspektivu diskriminace, tak rovnosti. Pon\u011bkud problematick\u00fdm je v\u0161ak kl\u00ed\u010dov\u00fd argument vyvozuj\u00edc\u00ed, \u017ee n\u00e1vrh je genderov\u011b neutr\u00e1ln\u00ed, jeliko\u017e m\u00e1 stejn\u00fd dopad na ob\u011b pohlav\u00ed. Term\u00edn gender se ale&nbsp;neomezuje pouze na dv\u011b pohlav\u00ed, obsahuje v&nbsp;sob\u011b i dal\u0161\u00ed kategorie (vztahovost \u2013 homosexualita; identita \u2013 transgender) (Pavl\u00edk, Hejzlarov\u00e1, 2007, s.&nbsp;13), kter\u00e9 by za \u00fa\u010delem v\u011bcn\u00e9 korektnosti bylo vhodn\u00e9 zohlednit.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"542\" height=\"189\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/8-6.jpg\" alt=\"\" class=\"wp-image-827\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/8-6.jpg 542w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/8-6-300x105.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/8-6-150x52.jpg 150w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/8-6-480x167.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 542px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">V&nbsp;p\u0159\u00edpad\u011b MV je nutno reflektovat zejm\u00e9na neobvykle vysok\u00e9 u\u017e\u00edv\u00e1n\u00ed term\u00ednu&nbsp;<em>dopad<\/em>&nbsp;(srov. MPSV). I p\u0159es to, \u017ee nej\u010detn\u011bj\u0161\u00ed formulace \u2013&nbsp;<em>n\u00e1vrh nem\u00e1\/nep\u0159edpokl\u00e1d\u00e1 (\u017e\u00e1dn\u00fd) dopad&nbsp;<\/em>(41 p\u0159\u00edpad\u016f) \u2013 je form\u00e1ln\u011b zcela v&nbsp;souladu s&nbsp;pravidly, ur\u010dit\u00e1 obsahov\u00e1 a v\u011bcn\u00e1 problemati\u010dnost formulace p\u0159etrv\u00e1v\u00e1. Z rozhovoru s&nbsp;jednou z expertek vypl\u00fdv\u00e1, \u017ee toto formulov\u00e1n\u00ed hodnocen\u00ed lze ozna\u010dit za chybn\u00e9. Zpravidla ka\u017ed\u00fd n\u00e1vrh m\u00e1 dopad na&nbsp;rovnost mu\u017e\u016f a \u017een\/z\u00e1kaz diskriminace, d\u016fle\u017eit\u00fdm je v\u0161ak ur\u010dit, zda je dopad neutr\u00e1ln\u00ed, pozitivn\u00ed \u010di negativn\u00ed. Obdobn\u00fd probl\u00e9m lze identifikovat u formulace \u201e<em>\u00faprava nem\u00e1 negativn\u00ed dopad<\/em>\u201c (n\u00e1vrh z\u00e1kona, kter\u00fdm se m\u011bn\u00ed z\u00e1kon \u010d. 553\/1991 Sb\u2026, 2012, s.&nbsp;43). Tv\u016frce sice jasn\u011b ur\u010duje, \u017ee dopad nen\u00ed negativn\u00ed, jak\u00fdm v\u0161ak je, z\u016fst\u00e1v\u00e1 skryto. Z&nbsp;hlediska jazykov\u00e9ho si pozornost zaslou\u017e\u00ed formulace \u201e<em>zm\u011bny by nem\u011bly m\u00edt \u017e\u00e1dn\u00e9 dopady<\/em>\u201c (n\u00e1vrh vyhl\u00e1\u0161ky, kterou se m\u011bn\u00ed vyhl\u00e1\u0161ka \u010d. 1\/2006 Sb\u2026, 2013, s.&nbsp;7). U\u017eit\u00fd podmi\u0148ovac\u00ed zp\u016fsob evokuje nejistotu tv\u016frce, zda tvrzen\u00ed skute\u010dn\u011b bude napln\u011bno, \u010di v&nbsp;to lze pouze doufat.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"543\" height=\"205\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/9-2.jpg\" alt=\"\" class=\"wp-image-829\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/9-2.jpg 543w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/9-2-300x113.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/9-2-150x57.jpg 150w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/9-2-480x181.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 543px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Obdobn\u011b i MZd nej\u010dast\u011bji formuluje dopady na rovnost do&nbsp;podoby n\u00e1vrh&nbsp;<em>nem\u00e1 (\u017e\u00e1dn\u00fd) dopad&nbsp;<\/em>(rozvedeno v\u00fd\u0161e u MV). Formulac\u00ed, kter\u00e1 se velice specificky sna\u017e\u00ed vyrovnat s&nbsp;legislativn\u00edmi zm\u011bnami, tj. p\u0159echodem od rovnosti \u017een a mu\u017e\u016f k&nbsp;z\u00e1kazu diskriminace, je \u201e\u2026<em>n\u00e1vrh je koncipov\u00e1n s&nbsp;d\u016frazem kladen\u00fdm na absolutn\u00ed zachov\u00e1n\u00ed z\u00e1kazu diskriminace s&nbsp;ohledem na v\u011bk, rasu, p\u0159\u00edslu\u0161nost k&nbsp;etnick\u00e9 men\u0161in\u011b \u010di n\u00e1bo\u017eensk\u00e9mu vyzn\u00e1n\u00ed.<\/em>\u201c (n\u00e1vrh z\u00e1kona o&nbsp;zdravotnick\u00fdch prost\u0159edc\u00edch\u2026, 2013, s.&nbsp;142). A\u010dkoli tv\u016frce postupuje v&nbsp;souladu s&nbsp;pravidly, vyjmenov\u00e1v\u00e1 \u0161irokou \u0161k\u00e1lu kategori\u00ed n\u00e1chyln\u00fdch k&nbsp;diskriminaci, opom\u00edj\u00ed ov\u0161em kl\u00ed\u010dov\u00fd term\u00edn pohlav\u00ed, p\u0159\u00edpadn\u011b gender. Z&nbsp;formulace se tak zm\u00edn\u011bn\u00e1 problematika zcela vytr\u00e1c\u00ed. Prax\u00ed MZd, je\u017e se v\u00fdrazn\u011b li\u0161\u00ed od chov\u00e1n\u00ed tv\u016frc\u016f MPSV a MV, je \u00fapln\u00e1 absence dopad\u016f na&nbsp;rovnost u&nbsp;n\u00e1vrh\u016f z&nbsp;roku 2014 (v\u0161ech deset n\u00e1vrh\u016f hodnot\u00ed z\u00e1kaz diskriminace). A\u010d pravidla toto explicitn\u011b nepo\u017eaduj\u00ed a postup je tedy zcela v&nbsp;souladu s&nbsp;metodick\u00fdm r\u00e1mcem, u MPSV a MV je v&nbsp;obdob\u00ed 2013\u20132014 hodnocen\u00ed na rovnost \u010dasto zachov\u00e1no (t\u00e9m\u011b\u0159 u t\u0159\u00ed \u010dtvrtin n\u00e1vrh\u016f), a&nbsp;to&nbsp;jako rovnocenn\u00fd partner z\u00e1kazu diskriminace. Jak dopl\u0148uje jedna z&nbsp;expertek, v&nbsp;p\u0159\u00edpad\u011b MPSV mohl hr\u00e1t roli i siln\u00fd tlak ze strany Odd\u011blen\u00ed, kter\u00e9 v&nbsp;dan\u00e9m obdob\u00ed spadalo pod MPSV.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u0161e zm\u00edn\u011bn\u00e9 odr\u00e1\u017e\u00ed i (ne)u\u017e\u00edv\u00e1n\u00ed jak\u00e9koli jednotn\u00e9 stupnice, nap\u0159\u00edklad stupnice doporu\u010dovan\u00e9 Odd\u011blen\u00edm rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed \u017een a mu\u017e\u016f \u2013&nbsp;dopad pozitivn\u00ed\/negativn\u00ed\/neutr\u00e1ln\u00ed. Jak ji\u017e bylo zm\u00edn\u011bno v\u00fd\u0161e, pozornost by zde m\u011bla b\u00fdt sm\u011b\u0159ov\u00e1na zejm\u00e9na k&nbsp;MPSV, kter\u00e9 \u010dasto operuje s&nbsp;jedn\u00edm z&nbsp;komponent\u016f stupnice (atribut&nbsp;<em>neutr\u00e1ln\u00ed<\/em>), av\u0161ak \u010dasto bez vazby na k\u00fd\u017een\u00fd term\u00edn&nbsp;<em>dopad<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.3 Kvalita v&nbsp;tvorb\u011b hodnocen\u00ed dopad\u016f na rovnost mu\u017e\u016f a \u017een<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V&nbsp;n\u00e1vaznosti na p\u0159edchoz\u00ed podkapitolu je nutno pouk\u00e1zat na p\u0159\u00edklady hodnocen\u00ed, je\u017e lze ozna\u010dit za kvalitn\u011b zpracovan\u00e1, a to nejenom co do souladu s&nbsp;metodick\u00fdm r\u00e1mcem, ale i zp\u016fsobu argumentace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jak ukazuje tabulka \u010d. 10, hodnocen\u00ed, kter\u00e1 v&nbsp;souladu s&nbsp;pravidly u\u017e\u00edvaj\u00ed term\u00edn&nbsp;<em>dopad,&nbsp;<\/em>poch\u00e1zej\u00ed v&nbsp;nadpolovi\u010dn\u00ed v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f od MV a ve 40 p\u0159\u00edpadech od MZd (srov. MPSV). Nadto, MV (ov\u0161em i MPSV) velice \u010dasto kombinuje pr\u00e1v\u011b v\u00fdraz&nbsp;<em>dopad<\/em>&nbsp;s&nbsp;doporu\u010dovan\u00fdm kl\u00ed\u010dov\u00fdm term\u00ednem&nbsp;<em>rovnost<\/em>. V&nbsp;p\u0159\u00edpad\u011b MPSV se takov\u00e9to od\u016fvodn\u011bn\u00ed vyskytuje celkem t\u0159in\u00e1ctkr\u00e1t, u MV dvakr\u00e1t a MZd ani jednou. Nejv\u00edce zmi\u0148ovan\u00fdmi jsou konkr\u00e9tn\u011b mezin\u00e1rodn\u00ed sm\u011brnice o&nbsp;zaveden\u00ed z\u00e1sady rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed a rovn\u00e9ho zach\u00e1zen\u00ed pro mu\u017ee a \u017eeny v&nbsp;oblasti zam\u011bstn\u00e1n\u00ed a povol\u00e1n\u00ed, \u010desk\u00e1 Listina z\u00e1kladn\u00edch pr\u00e1v a svobod \u010di nelegislativn\u00ed Strategie&nbsp;Evropa&nbsp;2020. V\u00fdskyt statistik a dat vztahuj\u00edc\u00edch se k&nbsp;genderov\u00e9 problematice, jako\u017eto podpory pro tvrzen\u00ed z&nbsp;hodnocen\u00ed, je u&nbsp;MPSV napln\u011bn v&nbsp;sedmi n\u00e1vrz\u00edch, v&nbsp;p\u0159\u00edpad\u011b MV u dvou a u MZd v&nbsp;jednom n\u00e1vrhu. Ve&nbsp;v\u0161ech zm\u00edn\u011bn\u00fdch se jedn\u00e1 o data segregovan\u00e1 dle pohlav\u00ed a jejich zdroji jsou nap\u0159. Eurostat, \u010cesk\u00fd statistick\u00fd \u00fa\u0159ad, \u00dastav zdravotnick\u00fdch informac\u00ed a statistiky \u010cR a V\u00fdzkumn\u00fd \u00fastav pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed. U MPSV se&nbsp;vyskytuj\u00ed i odkazy na odborn\u00e9 \u010dl\u00e1nky a studie, by\u0165 u dvou p\u0159\u00edpad\u016f.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Korektn\u00ed zp\u016fsob argumentace op\u011btovn\u011b vykazuje zejm\u00e9na MV, a to u&nbsp;informa\u010dn\u011b bohat\u00e9 a genderovou problematiku reflektuj\u00edc\u00ed formulace objevuj\u00edc\u00ed se v&nbsp;letech 2008\u20132009, kter\u00e1 krom popisu&nbsp;<em>dopad\u016f<\/em>&nbsp;<em>do rovn\u00fdch p\u0159\u00edle\u017eitost\u00ed a postaven\u00ed mu\u017e\u016f a \u017een,<\/em>&nbsp;zohled\u0148uje i dopady k&nbsp;dal\u0161\u00edm kategori\u00edm definovan\u00fdm konceptem GeM \u2013 \u201e\u2026<em>n\u00e1vrh nem\u00e1 \u017e\u00e1dn\u00e9 dopady ve&nbsp;vztahu k&nbsp;rovnosti postaven\u00ed z&nbsp;d\u016fvodu rasy nebo etnick\u00e9ho p\u016fvodu, sexu\u00e1ln\u00ed orientace, v\u011bku, zdravotn\u00edho posti\u017een\u00ed, n\u00e1bo\u017eenstv\u00ed \u010di v\u00edry, ani z&nbsp;jin\u00fdch obdobn\u00fdch d\u016fvod\u016f<\/em>\u201c (p\u011bt p\u0159\u00edpad\u016f). Ve sledovan\u00e9 dob\u011b je\u0161t\u011b metodiky nepo\u017eadovaly hodnocen\u00ed s ohledem na diskriminaci a MV je z\u00e1rove\u0148 jedin\u00fdm ministerstvem, kter\u00e9 hodnocen\u00ed formuluje v&nbsp;t\u00e9to komplexit\u011b. Za zm\u00ednku stoj\u00ed i pozoruhodn\u00fd zp\u016fsob argumentace, konkr\u00e9tn\u011b u\u017e\u00edv\u00e1n\u00ed z\u00e1poru, u tv\u016frc\u016f MZd a&nbsp;MV. Zat\u00edmco v\u011bt\u0161ina formulac\u00ed MPSV \u0159\u00edk\u00e1, jak\u00fd je n\u00e1vrh, co \u010din\u00ed, formulace t\u011bchto ministerstev c\u00edl\u00ed na to, jak\u00fd n\u00e1vrh nen\u00ed, co ne\u010din\u00ed a \u010demu se&nbsp;sna\u017e\u00ed br\u00e1nit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.4 V\u00fdvoj d\u016fle\u017eitosti hodnocen\u00ed dopad\u016f na rovnost mu\u017e\u016f a \u017een<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O podob\u011b \u010desk\u00e9ho RIA m\u00e1 mnoho co \u0159\u00edci i to, do jak\u00e9ho jazykov\u00e9ho \u00fatvaru je fin\u00e1ln\u00ed stanovisko formov\u00e1no a p\u0159edev\u0161\u00edm jak\u00fd rozsah (vyj\u00e1d\u0159en po\u010dtem slov) je mu v\u011bnov\u00e1n. T\u011bmto atribut\u016fm hodnocen\u00ed je nutno v\u011bnovat pozornost zejm\u00e9na z&nbsp;d\u016fvodu odhadovan\u00e9 p\u0159\u00edm\u00e9 \u00fam\u011bry mezi rozsahem formulace, tj. po\u010dtem slov dan\u00e9ho jazykov\u00e9ho \u00fatvaru a d\u016fle\u017eitost\u00ed, pozornost\u00ed, je\u017e je p\u0159isuzov\u00e1na a v\u011bnov\u00e1na dan\u00e9mu hodnocen\u00ed (\u010d\u00edm v\u00edce slov, t\u00edm v\u011bt\u0161\u00ed d\u016fle\u017eitost, pozornost). Sp\u00ed\u0161e sporadicky se objevuje kombinace v\u00edce jazykov\u00fdch \u00fatvar\u016f z\u00e1rove\u0148, s&nbsp;\u010d\u00edm\u017e logicky souvis\u00ed i v\u011bt\u0161\u00ed rozsah hodnot\u00edc\u00ed formulace. P\u0159\u00edkladem je hodnocen\u00ed MPSV prezentovan\u00e9 ve form\u011b \u010dty\u0159 v\u011bt a dvou souv\u011bt\u00ed (dvakr\u00e1t) \u010di hodnocen\u00ed obsahuj\u00edc\u00ed rekordn\u00edch p\u011bt souv\u011bt\u00ed a \u010dty\u0159 v\u011bt zaznamen\u00e1no u&nbsp;MV, a to ve t\u0159ech p\u0159\u00edpadech. D\u00e1le je nutno reflektovat i odli\u0161nost v praxi tv\u016frc\u016f MZd, kte\u0159\u00ed na rozd\u00edl od MPSV a MV, nej\u010dast\u011bji (35) v\u011bnuj\u00ed hodnocen\u00ed dopad\u016f na rovnost pouze n\u011bkolik slov \u010di \u010d\u00e1st v\u011bty (potvrzuje a souvis\u00ed s&nbsp;prax\u00ed hodnocen\u00ed v\u00edce dopad\u016f v&nbsp;r\u00e1mci jedn\u00e9 formulace \u2013 viz 3.2).<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"549\" height=\"163\" src=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/12-1.jpg\" alt=\"\" class=\"wp-image-835\" srcset=\"https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/12-1.jpg 549w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/12-1-300x89.jpg 300w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/12-1-150x45.jpg 150w, https:\/\/evaltep.xcreative.cz\/wp-content\/uploads\/2023\/08\/12-1-480x143.jpg 480w\" sizes=\"auto, (max-width:767px) 480px, 549px\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">V\u00fdstupem z&nbsp;tabulky \u010d. 11, na n\u011bj\u017e by m\u011bl b\u00fdt kladen d\u016fraz, je zejm\u00e9na pr\u016fm\u011brn\u00fd po\u010det slov, kter\u00fd nab\u00fdv\u00e1 jednozna\u010dn\u011b nejvy\u0161\u0161\u00ed hodnoty u&nbsp;MPSV. Naopak ministerstvem, kter\u00e9 v&nbsp;tomto v\u00fdstupu, pota\u017emo i dal\u0161\u00edch uveden\u00fdch zaost\u00e1v\u00e1, je MZd. Nap\u0159\u00ed\u010d v\u0161emi ministerstvy a lety se pr\u016fm\u011br slov nej\u010dast\u011bji pohybuje v&nbsp;intervalu od deseti do 20 slov. V\u00fdrazn\u011bj\u0161\u00ed r\u016fst nast\u00e1v\u00e1 jen v&nbsp;letech koncov\u00fdch. Pohyby k\u0159ivek MPSV a MZd u\u017e se, co do hodnot pr\u016fm\u011bru, v\u00edcem\u00e9n\u011b shoduj\u00ed, pov\u011bt\u0161inou nep\u0159ekra\u010duj\u00ed&nbsp;30 pr\u016fm\u011brn\u00fdch slov na jednu formulaci. Jak v&nbsp;p\u0159\u00edpad\u011b MPSV, tak MZd lze v&nbsp;obdob\u00ed 2007\u20132011 zaznamenat p\u0159ev\u00e1\u017en\u011b plynul\u00fd a pozvoln\u00fd r\u016fst. Kontrastem je k\u0159ivka MV, kter\u00e1 za\u017e\u00edv\u00e1 jak prudk\u00e9 n\u00e1r\u016fsty, tak p\u00e1dy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159evl\u00e1daj\u00edc\u00edm trendem je postupn\u00e9 zvy\u0161ov\u00e1n\u00ed pr\u016fm\u011bru po\u010dtu slov. Pokud bereme za platnou v\u00fd\u0161e nast\u00edn\u011bnou \u00fam\u011bru, ukazuje tento trend i na postupn\u00fd r\u016fst d\u016fle\u017eitosti a pozornosti v\u016f\u010di&nbsp;hodnocen\u00ed dopad\u016f na rovnost\/z\u00e1kaz diskriminace. Pozoruhodn\u00fdm je p\u0159edev\u0161\u00edm rok 2011, kdy je u&nbsp;v\u0161ech ministerstev zaznamen\u00e1n velk\u00fd pokrok. Vysv\u011btlen\u00ed tohoto zlomu p\u0159esahuje ambice tohoto \u010dl\u00e1nku \u2013 lze se jen dohadovat, jakou m\u011brou se&nbsp;na&nbsp;n\u011bm pod\u00edlely politick\u00e1 situace, r\u016fst aktivity, pos\u00edlen\u00ed pozice a vlivu Odd\u011blen\u00ed \u010di person\u00e1ln\u00ed obsazen\u00ed a (znalostn\u00ed) kapacita pro tvorbu hodnocen\u00ed vybran\u00fdch ministerstev. D\u00edl\u010d\u00ed roli v\u0161ak m\u016f\u017ee hr\u00e1t i to, \u017ee rok 2011 byl p\u0159\u00edpravn\u00fdm pro novelizaci obou pravidel, co\u017e znamenalo zv\u00fd\u0161en\u00ed pozornosti v\u016f\u010di&nbsp;hodnocen\u00ed, znovuo\u017eiven\u00ed informa\u010dn\u00edho z\u00e1kladu, a nadto byl spojen se vznikem Pracovn\u00ed komise (doporu\u010den\u00ed, kontrola; obnova pov\u011bdom\u00ed o d\u016fle\u017eitosti procesu, nabyt\u00ed informac\u00ed, strach z&nbsp;kontroly, v\u011bt\u0161\u00ed snaha) (Vl\u00e1da \u010cR 2011). Projevuje se i specifi\u010dnost let 2013 a 2014, kdy se pr\u016fm\u011br po\u010dtu slov rapidn\u011b zvy\u0161uje (v\u00fdjimkou MV). Vliv m\u016f\u017ee m\u00edt op\u011bt novelizace pravidel, prob\u00edhaj\u00edc\u00ed kontrola procesu, zah\u00e1jen\u00ed vl\u00e1dn\u00edho projektu zkvalit\u0148ov\u00e1n\u00ed RIA v&nbsp;roce 2012 \u010di v&nbsp;p\u0159\u00edpad\u011b MPSV i ji\u017e zm\u00edn\u011bn\u00fd tlak Odd\u011blen\u00ed (Vl\u00e1da \u010cR 2013). Opa\u010dn\u00fd trend u MV v\u0161ak mus\u00ed v\u00e9st k upozorn\u011bn\u00ed, \u017ee tato interpretace, pota\u017emo v\u00fdvoj nem\u016f\u017ee b\u00fdt automaticky pova\u017eov\u00e1n za v\u0161eobecn\u011b platn\u00fd, a \u017ee trajektorie ministerstev se r\u016fzn\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Z\u00e1v\u011br<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">C\u00edlem \u010dl\u00e1nku bylo evaluovat \u010deskou praxi hodnocen\u00ed dopad\u016f regulace na&nbsp;rovnost mu\u017e\u016f a \u017een v&nbsp;obdob\u00ed 2007\u20132014, u\u010dinit tak retrospektivn\u00ed exkurz do obdob\u00ed p\u0159ed implementac\u00ed Metodiky a zaplnit doposud neprob\u00e1danou oblast informacemi, je\u017e mohou b\u00fdt v&nbsp;budoucnu vyu\u017eiteln\u00e9 pro&nbsp;sledov\u00e1n\u00ed v\u00fdvoje v\u00fdstup\u016f tohoto n\u00e1stroje.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ve v\u00fdsledc\u00edch je zachyceno, \u017ee v\u00fdstupy hodnocen\u00ed jsou p\u0159ev\u00e1\u017en\u011b v nesouladu s&nbsp;ofici\u00e1ln\u00edmi po\u017eadavky metodick\u00fdch n\u00e1stroj\u016f pro tvorbu hodnocen\u00ed, a to zejm\u00e9na pokud jde o n\u00e1zev tituluj\u00edc\u00ed hodnot\u00edc\u00ed formulaci, od\u016fvodn\u011bn\u00ed a vysv\u011btlen\u00ed dopadu argumentovan\u00e9 relevantn\u00edmi daty a konzultacemi, doporu\u010dovanou autonomii hodnocen\u00ed jednotliv\u00fdch dopad\u016f a terminologick\u00fd r\u00e1mec. Staro\u0148ov\u00e1 (2007) shodn\u011b zaznamen\u00e1, \u017ee ji\u017e p\u0159i pilotov\u00e1n\u00ed RIA v&nbsp;letech 2005\u20132006 doch\u00e1zelo k&nbsp;odchylov\u00e1n\u00ed se od metodologick\u00fdch doporu\u010den\u00ed, a to zejm\u00e9na v u\u017e\u00edv\u00e1n\u00ed v\u00fdstup\u016f z&nbsp;konzultac\u00ed a kladen\u00ed nepom\u011brn\u00e9ho d\u016frazu na hodnocen\u00ed dopad\u016f ekonomick\u00fdch a administrativn\u00ed z\u00e1t\u011b\u017e. Zji\u0161t\u011bno d\u00e1le je, \u017ee \u0161k\u00e1la hodnot\u00edc\u00edch formulac\u00ed je ne\u0161irok\u00e1, lze vysledovat typick\u00e9 formulace a druhy argumentace jednotliv\u00fdch ministerstev. B\u011b\u017enou prax\u00ed je hodnocen\u00ed v\u00edce \u2013 \u010dasto vz\u00e1jemn\u011b nesouvisej\u00edc\u00edch<br>\u2013 dopad\u016f z\u00e1rove\u0148 (tzv. synt\u00e9zy), a to jak v&nbsp;jedn\u00e9 \u010dasti, tak jedn\u00e9 formulaci (souv\u011bt\u00ed). Prostor v\u011bnovan\u00fd formulaci je \u010dasto omezen\u00fd, sp\u00ed\u0161e mal\u00fd ve&nbsp;srovn\u00e1n\u00ed s&nbsp;prostorem v\u011bnovan\u00fdm dopad\u016fm jin\u00fdm. Zaznamen\u00e1n je v\u0161ak, co do pr\u016fm\u011bru po\u010dtu slov, p\u0159ev\u00e1\u017en\u011b trend roz\u0161i\u0159ov\u00e1n\u00ed d\u00e9lky formulac\u00ed. Je zde tedy p\u0159\u00edtomen ur\u010dit\u00fd v\u00fdvoj a proces rozhodn\u011b zcela nestagnuje. Znateln\u00e9 jsou n\u00e1sleduj\u00edc\u00ed zm\u011bny \u2013 roz\u0161i\u0159ov\u00e1n\u00ed d\u00e9lky formulace a neopom\u00edjen\u00ed dopad\u016f na rovnost ve prosp\u011bch nov\u011b implementovan\u00fdch dopad\u016f na&nbsp;z\u00e1kaz diskriminace. Negativa se naopak v&nbsp;pr\u016fb\u011bhu \u010dasu p\u0159\u00edli\u0161 nem\u011bn\u00ed a opakuj\u00ed se nap\u0159\u00ed\u010d v\u0161emi ministerstvy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Identifikov\u00e1ny jsou ov\u0161em i rozd\u00edly mezi srovn\u00e1van\u00fdmi ministerstvy. Nejenom MPSV, ale zejm\u00e9na pak MV odv\u00e1d\u00ed hodnocen\u00ed, kter\u00e9 lze, zejm\u00e9na co do souladu s&nbsp;metodick\u00fdm r\u00e1mcem, pova\u017eovat za korektn\u00ed. Kvalitu hodnocen\u00ed u MV vyzdvihuje i Staro\u0148ov\u00e1 (2010), proto nen\u00ed s&nbsp;podivem, \u017ee&nbsp;i&nbsp;v&nbsp;na\u0161em vzorku dominuje nad dal\u0161\u00edmi dv\u011bma ministerstvy. Konkr\u00e9tn\u011b se tak d\u011bje zejm\u00e9na v&nbsp;oblasti souladu u\u017e\u00edvan\u00e9 terminologie s metodick\u00fdm r\u00e1mcem, argumentace, rozsahu hodnot\u00edc\u00ed formulace, a t\u00edm p\u00e1dem i&nbsp;d\u016fle\u017eitosti v\u011bnovan\u00e9 tomuto typu dopad\u016f. MPSV naopak vynik\u00e1 relativn\u011b \u010dastou p\u0159\u00edtomnost\u00ed od\u016fvodn\u011bn\u00ed a konzultac\u00ed a stejn\u011b jako MV v&nbsp;rozsahu formulace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u00fdsledky d\u00e1le ukazuj\u00ed na absenci standardizace postupu hodnocen\u00ed a&nbsp;jak\u00e9koli metodiky hodnocen\u00ed, co\u017e za nemal\u00fd probl\u00e9m ozna\u010duj\u00ed i osloven\u00ed experti. Je v\u0161ak nutno p\u0159ipomenout, \u017ee na za\u010d\u00e1tku roku 2015 uvedlo Odd\u011blen\u00ed Metodiku specificky zac\u00edlenou na postup hodnocen\u00ed dopad\u016f na&nbsp;rovnost mu\u017e\u016f a \u017een, kter\u00e1 by tak m\u011bla p\u0159in\u00e9st ur\u010ditou zm\u011bnu. Experti potvrzuj\u00ed i dal\u0161\u00ed identifikovan\u00e9 n\u00e1lezy, a to upoza\u010fov\u00e1n\u00ed a bagatelizaci dopad\u016f na rovnost, v\u011bnov\u00e1n\u00ed ni\u017e\u0161\u00ed pozornosti a p\u0159isuzov\u00e1n\u00ed ni\u017e\u0161\u00ed d\u016fle\u017eitosti jejich hodnocen\u00ed a \u010dastou konfrontaci hodnocen\u00ed s&nbsp;indiferentn\u00edm p\u0159\u00edstup tv\u016frce. Tento p\u0159\u00edstup, a nadto i nedostate\u010dnou podporu ze strany vl\u00e1dy zachycuje i Staro\u0148ov\u00e1 (2007), a to v\u016f\u010di komplexn\u00edmu RIA jako n\u00e1stroji v&nbsp;obdob\u00ed jeho implementace (2005\u20132006). Experti d\u00e1le shrnuj\u00ed, \u017ee&nbsp;nejv\u011bt\u0161\u00ed bari\u00e9rou jak v&nbsp;jejich pr\u00e1ci (p\u0159ipom\u00ednkov\u00e1n\u00ed a kontrola n\u00e1vrh\u016f), tak praxi hodnocen\u00ed je nedostate\u010dn\u00e9 vzd\u011bl\u00e1n\u00ed a kvalifikace tv\u016frc\u016f v&nbsp;genderov\u00e9 oblasti (souvis\u00ed s n\u00edzk\u00fdm argumenta\u010dn\u00edm arzen\u00e1lem tv\u016frce), n\u00edzk\u00e1 genderov\u00e1 sensitivita a obecn\u00e1 neochota, nez\u00e1jem vych\u00e1zej\u00edc\u00ed z&nbsp;neztoto\u017en\u011bn\u00ed se s&nbsp;genderovou problematikou. Nen\u00ed tud\u00ed\u017e s&nbsp;podivem, \u017ee&nbsp;prax\u00ed je \u0161ablonovit\u00e1 a mechanick\u00e1 tvorba hodnocen\u00ed projevuj\u00edc\u00ed se kop\u00edrov\u00e1n\u00edm\/opisov\u00e1n\u00edm shodn\u00e9 formulace nap\u0159\u00ed\u010d v\u00edce n\u00e1vrhy. Na z\u00e1klad\u011b v\u00fd\u0161e uveden\u00e9ho lze identifikovat zp\u016fsob, jak\u00fdm \u010cR reaguje na proces evropeizace v&nbsp;p\u0159\u00edpad\u011b RIA. \u010cesk\u00e1 praxe hodnocen\u00ed dopad\u016f na rovnost mu\u017e\u016f a \u017een se odchyluje od, Evropskou uni\u00ed doporu\u010dovan\u00e9ho, \u201eide\u00e1ln\u00edho\u201c n\u00e1stroje Gender Impact Assesment, a to neexistenc\u00ed autonomn\u00edho n\u00e1stroje\/metodiky pro hodnocen\u00ed, terminologickou omezenost\u00ed a zastaralost\u00ed (absence term\u00edn\u016f odvozen\u00fdch od gender), minim\u00e1ln\u00ed reflex\u00ed zahrani\u010dn\u00edch p\u0159\u00edklad\u016f dobr\u00e9 praxe \u010di nespolupr\u00e1c\u00ed mezi teori\u00ed (koncept GeM) a&nbsp;prax\u00ed RIA. Lze tak usuzovat, \u017ee reakce \u010cR le\u017e\u00ed na pomez\u00ed absorpce a&nbsp;lhostejnosti. P\u0159esto\u017ee \u010cR legislativn\u011b o\u0161et\u0159uje RIA (OZRIA, Legislativn\u00ed pravidla vl\u00e1dy, Jednac\u00ed&nbsp;\u0159\u00e1d vl\u00e1dy) a zavazuje se k&nbsp;jeho napl\u0148ov\u00e1n\u00ed, adaptace je sp\u00ed\u0161e povrchov\u00e1, a to bez viditeln\u00fdch adekv\u00e1tn\u00edch v\u00fdstup\u016f. Je prezentovan\u00e1 sp\u00ed\u0161e navenek a \u201enaoko\u201c, nepronik\u00e1 ov\u0161em p\u0159\u00edli\u0161 do hloubky, nezakotvuje se p\u0159\u00edmo v&nbsp;praxi a v&nbsp;konkr\u00e9tn\u00edm jedn\u00e1n\u00ed akt\u00e9r\u016f. Typick\u00e1 je i&nbsp;ur\u010dit\u00e1 lhostejnost, s&nbsp;n\u00ed\u017e se pot\u00fdk\u00e1 jak problematika genderov\u00e9 rovnosti obecn\u011b, tak i jej\u00ed samotn\u00e9 hodnocen\u00ed v&nbsp;r\u00e1mci RIA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1v\u011brem je nutno znovu p\u0159ipomenout, \u017ee tento \u010dl\u00e1nek p\u0159inesl z\u00e1kladn\u00ed informa\u010dn\u00ed r\u00e1mec z&nbsp;kvantitativn\u011b orientovan\u00e9 obsahov\u00e9 anal\u00fdzy v\u00fdstup\u016f \u010desk\u00e9 praxe hodnocen\u00ed dopad\u016f regulace, a otev\u0159el tak dve\u0159e pro dal\u0161\u00ed zkoum\u00e1n\u00ed t\u00e9to oblasti. Pro vytvo\u0159en\u00ed ucelen\u00e9ho obrazu o \u010desk\u00e9 praxi by tak stranou v\u00fdzkumn\u00e9ho z\u00e1jmu nem\u011bla do budoucna z\u016fstat obsahov\u00e1 a&nbsp;v\u011bcn\u00e1 korektnost samotn\u00fdch hodnocen\u00ed, kter\u00e1 z&nbsp;d\u016fvodu absence jak\u00e9koli metodiky \u010di alespo\u0148 n\u00e1vodu pro tvorbu hodnocen\u00ed, nebyla v&nbsp;dob\u011b prov\u00e1d\u011bn\u00ed na\u0161\u00ed anal\u00fdzy uskute\u010dniteln\u00e1. V&nbsp;r\u00e1mci dal\u0161\u00edho zkoum\u00e1n\u00ed by se jako&nbsp;kl\u00ed\u010dov\u00ed informa\u010dn\u00ed partne\u0159i m\u011bli zva\u017eovat i samotn\u00ed tv\u016frci z jednotliv\u00fdch ministerstev. Kvalitativn\u011b postaven\u00fdmi anal\u00fdzami by se tak otev\u0159ela mo\u017enost pro zji\u0161\u0165ov\u00e1n\u00ed d\u016fvod\u016f, pro\u010d se hodnocen\u00ed prov\u00e1d\u00ed zrovna takov\u00fdmto zp\u016fsobem a co za t\u00edmto stoj\u00ed. V\u00fdvoj se i p\u0159es to uk\u00e1zal<br>jako&nbsp;shodn\u00fd.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Regulatory Impact Assessment (RIA) in the Czech Republic and namely its part focusing on equality between men and women is considerably underresearched in terms of its real form, content and specifics of the RIA performance as well as the extent of its compliance with the official guidelines. The dataset containing 236 outputs of the RIA performed by three ministries in 2007\u20132014 is put to evaluation through the created analytical tool. Subsequently, the outcomes of the analysis are triangulated through expert interviews. The paper concludes that the RIA on equality between men and women is affected by the low compliance with the guidelines, overshadowing and downplaying of the impact on equality, low variability and mechanical creation of the assessment outputs, simultaneous assessment of more and different impacts and solely superficial knowledge of the gender issue. In addition, systemic obstacles, including indifferent approach to the gender issue, absence of unified methodology for RIA on equality between men and women, contradiction and inadequacy ofthe guidelines novelizations and limited personnel capacity of the key actors are identified. However, the transformation is detected, particularly of the assessment output extent and systemic activities aimed to support gender issue.
